Lawsuit Filed Against Pennsylvania Governor Over Mask Mandate in All Schools

PENNSYLVANIA – A lawsuit has been filed [1] against Governor Tom Wolf over his mandate for COVID-19 vaccinations in all of the state’s schools.


Among the plaintiffs are Republican Senate President Pro Tempore Jake Corman, Republican Representative Jesse Topper, two private Christian schools, and parents in three public school districts from two counties. Those districts are Wyomissing Area in Berks County, and Butler Area and Slippery Rock Area, both in Butler County.

According [3] to the lawsuit, “The Secretary of Health’s order subjects healthy, non-infected teachers, children, students, staff, and visitors…to the wearing of face coverings.”


The lawsuit intends to put a stop to the mask mandate that is said to take effect on Tuesday and has a trial date of September 16.

The mandate was set in place originally because most of the state’s 500 school districts didn’t impose mandates of their own.

The lawsuit claims that the mask mandate is not valid as the governor failed to send it through the regulatory review process in the state. It also alleges that Wolf is attempting to “circumvent newly approved constitutional amendments limiting a governor’s emergency powers.”

A spokesperson to the governor, Lyndsay Kensinger, said the authority for the mandate is “clearly outlined in existing law.” She continued, “We need Republicans to stop spending their time undermining public heath and instead encourage people to get vaccinated.”
