Sidney Powell Files Vaccine Mandate Lawsuit Against The Pentagon

Sidney Powell, the former lawyer of Donald Trump, has filed a lawsuit against the Department of Defense in the hopes of blocking the Pentagon from enforcing its COVID-19 vaccine mandate.

The Hill [1] reported that Powell’s Texas-based group Defending the Republic announced this week that it filed a lawsuit against Defense Secretary Lloyd Austin on behalf of sixteen active-duty service members “in support of their right to refuse” the COVID-19 vaccine.


“Through the filing of this lawsuit, we make clear that these service members — those who serve their country with honor — are not the property of the U.S. government, and the Constitution does not allow them to be treated as such,” the group said in a statement posted to its website [3].

The Pentagon mandated that all service members be vaccinated in late August. It announced earlier this week that its 700,000 civilian employees will have to be fully vaccinated by November 22.

“Soldiers are not the property of the government,” Powell said in an email obtained by Bloomberg News [4]. “We seek to protect their individual rights to decide what’s best for their own lives and health in the face of this dangerous, experimental, and unnecessary’ vaccine.'”

The plaintiffs are arguing that the mandate imposes “unconstitutional conditions by forcing Plaintiffs to choose between the violation of their constitutional rights or facing life-altering punishments.” They are seeking a court ruling that says the FDA’s approval of Pfizer’s vaccine is unconstitutional.


Aside from Austin, the suit also names Health and Human Services Secretary Xavier Becerra and acting FDA Commissioner Janet Woodcock as defendants. Powell reportedly has trouble finding a judge to hear this lawsuit, as two have already recused themselves. One of these judges was U.S. District Judge Kent Wetherell, who made the excuse that he and his wife both own Pfizer stock and the company could become involved in the case. The second judge did not reveal why they were recusing themselves.

This comes after Powell said that she’s acing at least $3 billion in legal threats from various voting machine companies over her claims that the presidential election was rife with fraud. However, Powell said they need to “take a number” because she doesn’t have the “tiniest fraction” to cover the sought damages.

“Dominion is suing me personally for $1.3 billion, and then Smartmatic is suing me for $2.7 billion, I think, in New York. And then Eric Coomer, who used to work with Dominion, is suing me in Colorado,” she said with a laugh, according to Yahoo News [7]. “I mean, we need a take-a-number system now for people who want to sue Sidney Powell, who doesn’t have the tiniest fraction of that amount of assets. We could write that check and watch it bounce to infinity and beyond.”
