MyPillow CEO Mike Lindell is firing back by suing the House select committee that is investigating the January 6 Capitol riot after they subpoenaed his phone records.
Filed in the U.S. District Court of Minnesota, Lindell’s lawsuit states that the committee issued a subpoena to Verizon for all of his records of communication on a designated cellphone number between November 1, 2020, and January 31, 2021. Lindell is claiming that this subpoena is a violation of his First Amendment and Fourth Amendment rights, alleging that committee members “acted without authority because they were not validly organized as a House committee” under the rules of the House.

The lawsuit goes on to state that the RINO Reps. Liz Cheney (WY) and Adam Kinzinger (IL), who are the only two Republicans on the committee, were “removed from the Republican Caucus” and therefore “have no legitimate power to issue enforceable subpoenas.” However, both of them are, in actuality, still members of the Republican Party and the House Republican caucus, according to The Hill.
The lawsuit then alleges that House Minority Leader Kevin McCarthy (R-CA) was not consulted about nominations for this committee. Lindell then argued that the subpoena “exceeds the authority of the Select Committee” because it requests “records that are far beyond the scope of the Select Committee’s investigation.”
Lindell is asking either that the subpoena be invalidated, that he be given the opportunity to review requested information before it is given to the panel so he “may assert any applicable claim of attorney-client or other privilege.”
The lawsuit slams the committee’s subpoena as “a veiled effort to conduct an unauthorized criminal investigation, and it is not in furtherance of a valid legislative purpose.”
Lindell is not the only person who has filed a lawsuit in response to a subpoena from this committee, with others who have done the same thing, including Former Trump White House chief of staff Mark Meadows, attorney John Eastman, radio host Alex Jones, Trump spokesman Taylor Budowich, and conservative pundit and onetime Trump White House adviser Sebastian Gorka.
Lindell has been an outspoken supporter of Donald Trump’s for years, and he has led the charge in trying to prove that the 2020 election was stolen from him. It remains to be seen how his lawsuit will play out.
