San Pablo, CA – The San Pablo Police Department recently released bodycam video footage from a police shooting incident that occurred in September 2023. The man involved, 44-year-old Andre Smith, was hospitalized and placed in critical condition but survived.

The incident unfolded on September 8 when police received a distress call at 1:39 p.m. from a residence on the 2600 block of Dover Avenue. The caller, Smith’s wife, reported that her husband was displaying signs of schizophrenia. She also mentioned the presence of her parents and two children in the house. The police have released the complete video, including audio from the 911 call made by Smith’s wife.

Upon arrival, San Pablo Police Department (SPPD) officers attempted to establish communication with Smith, who refused to engage with them. Approximately an hour later, Smith’s wife made another call to the police, stating that her husband continued to harass her. During the call, Smith can be heard uttering threatening statements directed at the police.

In the audio, Smith expressed frustration, stating, “I don’t want to live this no more, and I’m tired of this injustice. I don’t want to go to court. I ain’t going to court. I’d rather go after their throat. If they kill me, then they kill me. But when it’s time for them to die, I’m going to throw them into a lake of fire and torch ’em.”

Responding to the second call, the police returned to the scene. Body camera footage reveals an officer escorting Smith’s wife and another individual to safety. Smith, in the video, can be seen holding two metal poles before the officers fired bean bag rounds in an attempt to subdue him. Smith then retreated to the side of the house.

After a duration of approximately 16 minutes, Smith emerged from the side of the house and headed back to the front lawn. The bodycam footage captures Smith hurling several rocks at the group of officers, prompting them to fire additional bean bag rounds and deploy tasers in an effort to bring him under control. Despite these measures, Smith remained unyielding.

The situation escalated further when Smith charged at an officer while wielding a chair and a metal pole. The video shows the officer dodging the swing before tackling Smith. During this altercation, another officer discharged their firearm, shooting Smith in the leg.

Smith sustained a gunshot wound and was immediately transported to the hospital in critical condition. However, he eventually recovered and was subsequently discharged.

On November 13, the Contra Costa County District Attorney’s Office charged Smith with two felony counts of assault with a deadly weapon with force likely to cause great bodily injury to a peace officer. Additionally, the DA’s office is conducting an investigation into the police shooting incident to determine its legality and appropriateness.
