Days later, Nobles and her attorney, Brian Claypool, spoke in an interview with NewsNation, shedding light on their pursuit of justice through the lawsuit. Nobles expressed frustration, stating, “Nobody at the border did their job and checked his background.” She firmly believes that if the suspect had been properly screened, his MS-13 gang affiliation would have been revealed, preventing the tragic loss of her daughter’s life.

The horrifying incident took place on July 27, 2022, in Frederick, Maryland. Hamilton was raped and strangled to death inside her own trailer, which she shared with the suspect, who allegedly sublet the property from another undocumented migrant. The suspect was apprehended in January 2023 after authorities matched his DNA to evidence from the crime scene. He now faces charges of first-degree murder, rape, and robbery, with his trial scheduled for June 28.

U.S. Immigration and Customs Enforcement (ICE) later confirmed that the suspect, a 17-year-old El Salvador native, was associated with the notorious Mara Salvatrucha gang, also known as MS-13. Nobles and Claypool argue that the teen should never have been allowed entry into the country, highlighting the failure of the Department of Homeland Security to follow proper protocols.

“We’re bringing this lawsuit because we’re tired of being held hostage in our own country,” Claypool proclaimed during the interview. He expresses dissatisfaction with the DHS’s negligence and calls for accountability. Claypool emphasizes, “All they had to do was follow their own protocol – lift the t-shift of the 16-year-old young man that was trying to enter the border [and] they would have seen a gang-related tattoo. And guess what? That would have disqualified him from entering this country. He should have been sent back at that very second to El Salvador.”

Furthermore, Claypool points out the Department of Health and Human Services’ responsibility in allowing the suspect to enter a holding facility without confirming his verified sponsor, a relative with a known and verified identity. Their negligence, according to Claypool, resulted in the suspect escaping and, ultimately, residing with Hamilton in the trailer where the tragedy occurred.

The Department of Homeland Security and the Department of Health and Human Services were both approached for comments on the matter but have not yet responded.

This tragic case has further ignited the Republican-led House Judiciary Committee’s concerns over the Biden regime’s open-borders policy. In a recently published report, the Committee highlights the administration’s failure to implement necessary screening and vetting measures to protect American citizens from dangerous criminals and gang members.
