Putting the cart in front of the horse, the analysis spells-out clearly and unequivocably that in accordance with Article II, Section IV of the U.S. Consitution, it’s time to impeach Secretary of Defense Lloyd Austin: “The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.”

The statutory authority for impeachment is found in Article II, Section IV and the term “civil Officers” as it applies to SecDef remembering that, “The position of Secretary of Defense is unique within the U.S. government; it is one of two civilian positions within the military chain of command, although unlike the President, the Secretary of Defense is not elected” [Congressional Research Service].

As Christmas 2023 unpacked and rolled into 2024, U.S. Secretary of Defense Lloyd Austin bailed in secret and hid-out in ICU after having an elective procedure for gastric banding, as it was reported, which ended up actually being a procedure for prostate cancer.

You know, that whole “turbo cancer” thing….
“On the evening of January 1, Secretary of Defense Lloyd J. Austin III was admitted to Walter Reed National Military Medical Center,” failing to ever inform Biden, White House staff, Congress or Pentagon officials, according to reporting.
Subsequent reporting indicates that Austin’s prostate cancer procedure occurred on 22 Dec 23 and that he was readmitted on 01 Jan 24 when he entered ICU for complications related to the initial procedure.
In remarkable ways to leave one slack-jawed, National Security Council spokesman John Kirby advised that Biden was not made aware of Austin’s cancer diagnosis until 09 Jan 24; nearly three weeks after the initial procedure.

As SecDef and in accordance with the National Command Authority and the onuses of those within it, Austin bears a clear responsibility to maintain the adequate and appropriate flow of two-way communication and advisement up the chain to the Commander in Chief, President Joe Biden, and down the chain to subordinate staff as required.
This would include fitness for duty and for which there is an existing procedure to be followed in order to notify up-chain to the Commander in Chief and down-chain to staff and offices.
Especially important in such instances are considerations of continuity of government and internally, continuity in command, where effective communication triggers contingencies to guarantee the latter.
In the case of Austin being unfit for duty and incapable of executing those duties, he is statutorily required to communicate up and down the chain of command to communicate that, “the Deputy Secretary of Defense [Kathleen Hicks] shall act for, and exercise the powers of, the Secretary of Defense, including when the Secretary is unable to perform the functions and duties of his office.”
Austin never did this.
Hicks never knew and neither did Biden.
Hicks began assuming Lloyd’s statutory duties and responsibilities on 02 Jan 24; a day after Austin’s admittance to ICU.
The operational chain of command dictates that SecDef communications flow sequentially up the chain to POTUS and down the chain to something called the ‘combatant commands’.
