In a release from the Office of Police Accountability (OPA), it was confirmed that their report agrees with previous investigations, affirming the actions taken by a Boise police officer in January 2023. The officer in question, Sgt. Kirk Rush of the Boise Police Department (BPD) had used deadly force against Harry Chester Andrews, who threatened the police with a knife while walking on the “Flying Wye” section of I-84.

The Use of Force Investigative Report conducted by the OPA concluded that Sgt. Kirk Rush’s response to Andrews was “reasonable” and deemed it an act of self-defense. The incident unfolded on January 3, 2023, when officers were called to respond to a man walking in the westbound lanes of the interstate. Upon arrival, they discovered Andrews walking on I-84 with a knife in his hand.

According to the report, Sgt. Rush instructed Andrews to drop his knife and get on the ground. However, Andrews failed to comply with the officer’s commands and instead charged at Sgt. Rush with the knife. Faced with this imminent threat to his safety, Sgt. Rush fired his weapon, injuring Andrews. Andrews was promptly transported to a hospital for treatment.

Subsequently, in October 2023, Andrews pleaded guilty to aggravated assault upon certain personnel with a deadly weapon enhancement. This reinforced the seriousness of the incident and the potential harm that could have been caused to the officers involved.

On January 11, 2024, Andrews was sentenced to 25 years in prison for the aforementioned charges. The Ada County Prosecutor’s Office cited an additional concerning factor during Andrews’ detainment and medical attention. Andrews reportedly made a chilling statement to the officers, expressing his intent to cause harm by saying, “I wanted to kill you.”

On the same day as the sentencing, Gem County Prosecuting Attorney Erick Thomson issued a press release reaffirming Officer Rush’s actions, supporting the officer’s decision to use lethal force in order to protect himself and his fellow officers.
